Hi i wrote to you before about having the bailiff come and remove my renter. well it is now 7 days later and i found an order posted on my gate which by the way is 1/4 of a mile from my house saying that a stay has been granted. I didnt even get served to go to court. But according to the affidafated she apperantly taped it to the gate in the storm on monday. In which case the papers could be in the next county by now. regardless i did not receive notice of the court date and therefore i did not attend. The order i plucked off my gate today says that i am to let her in by 5 pm tomorrow or any money im to receive will be prorated. my question is she is already removed by the bailiff and the house has been secured by him. do i have to let her back into my property or do i need to contact my lawyer in the morning or is there some recourse i can take. also she has in no way tried to make contact with me as the order left by the bailiff said she was suppose to in order to obtain her property. My gates are locked as this is my home place of recidence and the other home is on the same property. also i have a family member that will be moving in as soon as we get her stuff out of here.
Hi I have had the bailiff come and remove the renter on a notice of default which she did not adhere to. the bailiff removed her but her property is still here. my question is how long do I have to keep this property and what if she doesn’t contact me to obtain it.
Hi Holly,
If the value of the goods are over $2,000 you have to hold it for 30 days then you can auction it off to recover lost rent. You also need to inventory everything, which is actually good practice even if it’s junk so they don’t come back two months later saying you threw away a priceless antique.
